Survey Findings Support Algae Contaminated Water
Plaintiffs previously revealed findings for toxic mold syndrome. At this juncture, Plaintiffs are entering into evidence additional surveys of h. pylori and Morgellons disease.34 H. pylori is a debilitating stomach disease caused by ingesting larger than trace amounts of feces. This bacteria drills its way into the stomach’s lining, then lives by eating the mucous layer between the stomach’s inner and outer walls. Morgellons disease attacks the skin, than travels to the central nervous system. In the net thrown out for h. pylori, Morgellons disease and toxic mold symptoms, we managed to capture every symptom but fevers for ingesting algae contaminated water.

Morgellons disease and toxic mold disease both attack the brain. Among the most prevalent Morgellons’ symptoms reported by claimants is a short term memory loss – short term as in forgetting the beginning of a sentence before reaching its end, a change in vision and mental confusion. Toxic mold syndrome also goes to the brain. Among its most prevalent symptoms are blurry vision, mood swings and unusual memory problems. There is no cure for either of these diseases. H. Pylori is a long term chronic stomach ailment that can lead to stomach ulcers. These are all chronic, long term diseases that strongly impact the quality of a person’s life. Many claimants are suffering from all three of these diseases. Symptoms for these illnesses predominantly appeared after Hurricane Rita.
Mitigating evidence presented by Defendant on contaminated water has been countered with new evidence, stating that five weeks without electricity, coupled with humid and hot air, caused blue green algae to grow and contaminate the million gallon water tank. Plaintiffs have also discredited the evidence presented by Defendant relating to the absence of toxic mold and a fully operational medical department. Any one of these elements – widespread toxic mold, a non-functioning medical department or algae contaminated water – would render the Medium prison unsuitable and breach their duty to provide Plaintiffs with safekeeping, care and subsistence. Defendants have not carried their burden under Rule 56(e).
